1. Agreement and who may use LemonSnap
These Terms form an agreement between the person or organization using LemonSnap (“you”) and LemonSnap (“we,” “us,” or “LemonSnap”). By using the website, creating an account, downloading a resource, or purchasing access, you agree to these Terms, the Privacy Policy, the Resource Licence, and the Billing & Refund Policy. If you use LemonSnap for a school, school board, employer, or other organization, you confirm that you are authorized to act for it. Accounts and paid plans are intended for adults. Students may use materials only under the direction of a teacher, parent, guardian, or school.
2. The service
LemonSnap provides previews and downloadable educational resources, including student pages, answer keys, rubrics, and editable files where listed. Catalog availability, formats, features, and resource status may change. A preview is provided to help you review a resource before downloading it; it is not permission to extract, scrape, reproduce, or republish the preview outside the Resource Licence.
Resources marked unavailable, on hold, archived, or under review are not part of the active catalog and may not be distributed as approved LemonSnap materials.
3. Accounts and security
You must provide an email address you control, keep your password confidential, and promptly notify us if you suspect unauthorized access. One individual account may not be shared among unrelated users. School and board access is governed by the applicable organization agreement. You are responsible for activity performed through your account unless caused by LemonSnap’s failure to use reasonable safeguards.
We may require email verification, limit repeated sign-in attempts, end expired or suspicious sessions, and temporarily restrict activity that appears automated, abusive, fraudulent, or inconsistent with classroom use.
4. Free downloads and fair use
Visitors may download up to five distinct free resources per calendar month without an account, subject to technical controls intended to prevent circumvention. Re-downloading the same resource may not count again. Free access is offered to human users for ordinary classroom evaluation and use. Clearing cookies, changing devices or networks, creating multiple accounts, or using automation to evade a limit is prohibited.
Paid teacher access, once launched, is designed for ordinary use by one teacher and their own classes. It does not permit automated retrieval, mirroring the catalog, mass extraction, systematic archiving, credential sharing, resale, or building a competing library. Reasonable daily and monthly safeguards may pause unusually large download activity. Contact us when legitimate classroom or school needs exceed those safeguards.
5. Acceptable use
You may not: interfere with site operation or security; probe or bypass access controls; use bots, scrapers, crawlers, or bulk-download tools except ordinary search-engine indexing that follows our published rules; upload malware or harmful code; impersonate another person; use the service unlawfully; submit knowingly false reports; harvest personal information; reverse engineer protected delivery mechanisms; train or evaluate an AI model on the catalog or resources without written permission; or use LemonSnap content to create, market, or improve a competing product or resource library.
6. Educational judgment and content
LemonSnap aims to provide accurate, age-appropriate, curriculum-connected resources, but no resource can account for every learner, accommodation, school policy, curriculum interpretation, or classroom context. Teachers and schools must preview materials, exercise professional judgment, provide needed accommodations, and follow applicable school-board, safety, assessment, privacy, and legal requirements. Answer keys and rubrics support teacher judgment; they do not replace it.
Unless expressly stated, LemonSnap is not a ministry-approved textbook, assessment authority, legal or medical service, or substitute for emergency, professional, or individualized advice.
7. Ownership and licence
The website, catalog organization, branding, software, original text, layouts, illustrations, resource files, and related materials are owned by LemonSnap or used with permission and are protected by applicable intellectual-property laws. Your permitted use is set out in the Resource Licence. No ownership is transferred to you. Feedback and issue reports remain yours, but you give LemonSnap a non-exclusive, worldwide, royalty-free licence to use them to investigate, correct, and improve the service, without publishing personal information unnecessarily.
8. Third-party services and links
LemonSnap may rely on service providers such as Cloudflare for hosting and security, Stripe for payments and billing, and Resend for account email. Their services are governed by their own terms and privacy practices. Links to external websites are provided for convenience or source context; LemonSnap does not control and is not responsible for external content or availability.
9. Suspension and termination
We may limit, suspend, or close access when reasonably necessary to protect users, rights, security, service integrity, payment status, or compliance with these Terms. Where practical, we will give notice and an opportunity to correct the issue. You may stop using LemonSnap at any time and may request account deletion, subject to records we must retain for security, billing, fraud prevention, dispute resolution, or law. Sections that by their nature should survive termination—including ownership, licence limits, disclaimers, liability limits, indemnity, and dispute terms—continue to apply.
10. Disclaimers
To the maximum extent permitted by law, LemonSnap and its content are provided “as is” and “as available.” We do not promise uninterrupted or error-free operation, that every resource will fit every classroom, or that all content will remain available. We disclaim implied warranties and conditions to the extent the law permits. Nothing in these Terms excludes a warranty, condition, remedy, or right that cannot lawfully be excluded.
11. Limits of liability
To the maximum extent permitted by law, LemonSnap will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profit, revenue, data, opportunity, goodwill, or anticipated savings arising from use of the service. For claims that may lawfully be limited, LemonSnap’s total liability arising from the service during any 12-month period will not exceed the greater of (a) the amount you paid LemonSnap during that period and (b) CAD $100.
These limits do not apply to liability that cannot be limited by law, or to LemonSnap’s fraud, wilful misconduct, or gross negligence. Some jurisdictions do not permit particular exclusions, so a limitation applies only to the extent allowed there.
12. Your responsibility for misuse
To the extent permitted by law, you will indemnify and hold LemonSnap harmless from third-party claims, losses, and reasonable costs arising directly from your unlawful use, unauthorized redistribution or resale of resources, infringement caused by material you submit, deliberate circumvention of safeguards, or material breach of these Terms. This obligation does not apply to the extent a claim was caused by LemonSnap’s own breach, negligence, or misconduct.
13. Governing law and disputes
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any consumer right that cannot be waived, the courts of Ontario have jurisdiction. Before filing a claim, each party should give the other written notice describing the issue and allow 30 days for a good-faith attempt to resolve it. This informal step does not shorten or waive a legal limitation period or prevent urgent injunctive relief.
14. Changes and general terms
We may update these Terms when the service, law, or business changes. We will post a new effective date and, for material changes affecting account holders, provide reasonable notice and seek renewed consent where required. If a provision is unenforceable, it will be limited or removed only as necessary and the remaining provisions continue. A failure to enforce a provision is not a waiver. These Terms and the linked policies are the entire agreement for ordinary website use unless a signed school or board agreement says otherwise.
